Terms of Service

These Terms explain how Chakam works, what you can expect from us, and what we expect from you. Sections most people ask about: who owns uploaded photos (Section 6), watermarked previews (Section 7), and refunds (Section 11).

1. Acceptance of These Terms

These Terms of Service (“Terms”) form a binding agreement between you and Chakam(“we”, “us”, or the “Platform”) governing your access to and use of our websites, applications, event galleries, and related services (collectively, the “Service”).

By creating an account, opening a gallery link, viewing, uploading, or purchasing media through the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Definitions

“Host” means a user who creates an event, uploads media to an event gallery, configures gallery access, or offers media for viewing or purchase through the Service.

“Guest” means a user who accesses an event gallery via an invitation, shared link, or access code to view, react to, or purchase media.

“Content” means any photos, videos, captions, comments, profile information, or other material uploaded to or generated through the Service.

“Preview Media” means watermarked, resized, or otherwise protected versions of Content made available before purchase or authorization.

3. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or transact on the Service. By registering, you confirm that all information you provide is accurate and kept up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Accounts are personal and may not be shared, sold, or transferred. Notify us immediately at tejiri@chakam4u.com if you suspect unauthorized access to your account.

We may refuse registration, reclaim usernames, or limit account features where reasonably necessary to protect the Service or other users.

4. Host Responsibilities

As a Host, you are responsible for the events and galleries you create. You must:

(a) only upload Content that you own or are licensed and authorized to upload; (b) obtain all necessary consents from people who appear in your Content before uploading, including consent from a parent or guardian for any minors; (c) configure gallery access appropriately for the sensitivity of the event; (d) accurately describe any media offered for sale; and (e) comply with all laws applicable to your event, your attendees, and your use of the Service, including photography, privacy, and consumer protection laws.

You are solely responsible for how you distribute gallery links and access codes. Anyone holding a valid link or code may be able to view the associated gallery according to its settings.

5. Guest Access & Responsibilities

Guest access to a gallery is a limited, personal, revocable permission granted for the purpose of viewing and, where enabled, downloading or purchasing media from that event. Guests must not share gallery links or access codes beyond the audience intended by the Host, and must not use Content from a gallery for any commercial purpose without the rights holder’s permission.

A Host or the Platform may revoke or restrict gallery access at any time, including after an event has ended.

6. Your Content & the License You Grant Us

You keep ownership. Uploading Content to the Service does not transfer ownership. Photographers, Hosts, and creators retain all intellectual property rights in their Content.

License to operate the Service. By uploading Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, resize, watermark, transcode, transmit, and display that Content solely as needed to operate, secure, and improve the Service and to deliver it to the audiences you authorize. This license ends when your Content is deleted from the Service, except for limited backup copies retained for a reasonable period and copies already lawfully delivered to other users (for example, purchased downloads).

We do not sell your Content. We will not license or sell your Content to third parties for their own purposes without your explicit consent.

7. Watermarks, Previews & Protected Media

Preview Media is protected by watermarks, signed URLs, resolution limits, and other technical measures. You must not bypass, remove, obscure, or attempt to circumvent these protections, and you must not scrape, bulk-download, screenshot for redistribution, or otherwise extract Preview Media without completing the required purchase or receiving the rights holder’s authorization.

Circumventing content protection is a material breach of these Terms and may result in immediate account termination and legal action.

9. Privacy & Data Protection

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. We design our data practices around recognized standards, including the Nigeria Data Protection Act (NDPA), the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA), where they apply to our users.

In summary: we collect only the data needed to operate the Service; media files are stored with reputable cloud infrastructure providers using encryption in transit; access to original (non-preview) media is gated by authenticated, signed requests; and you may request access to, correction of, or deletion of your personal data as described in the Privacy Policy.

10. Prohibited Activities

You must not use the Service to:

(a) upload Content that is illegal, defamatory, harassing, hateful, sexually exploitative, or that depicts or endangers minors in any harmful way; (b) infringe any copyright, trademark, privacy, or publicity right; (c) impersonate any person or misrepresent your affiliation; (d) attempt to gain unauthorized access to accounts, galleries, systems, or data; (e) interfere with the Service through malware, automated scraping, load attacks, or manipulation of purchase and access flows; (f) resell, sublicense, or misuse gallery links, access codes, or Preview Media; or (g) use the Service in any manner that violates applicable law.

We may remove Content, restrict features, or suspend accounts that we reasonably believe violate this section, and we may report unlawful activity to relevant authorities.

11. Payments, Purchases & Refunds

Prices for media purchases, upgrades, and subscriptions are shown before checkout. Payments are processed by third-party payment providers, and your use of those providers is subject to their own terms. We do not store full card details on our servers.

Because purchased media is delivered digitally and immediately, purchases are generally final once the download or full-resolution access has been delivered, except where a delivery fails, the media is materially not as described, or a refund is required by applicable consumer protection law. Nothing in these Terms limits statutory rights that cannot be waived.

Hosts offering paid media are responsible for the accuracy of their listings, for any taxes applicable to their earnings, and for honoring the access they sell. Suspected fraudulent transactions may be reversed, withheld, or reported.

12. Third-Party Services

We rely on vetted third-party providers to operate the Service, including cloud storage and content delivery providers, payment processors, email and notification services, and privacy-respecting analytics and monitoring tools. These providers process data only as needed to provide their services to us. A current list of material subprocessors is available on request or in our Privacy Policy.

The Service may contain links to third-party websites or services we do not control. We are not responsible for their content or practices.

13. Copyright & Content Complaints

We respect intellectual property rights and expect users to do the same. If you believe Content on the Service infringes your copyright or other rights, submit a notice identifying the Content, its location (gallery or URL), your rights in it, and your contact details. We will review notices promptly and may remove or disable access to the Content, notify the uploader, and terminate the accounts of repeat infringers.

Knowingly submitting false infringement claims may expose you to liability.

14. Service Availability & Changes

We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation, nor unlimited storage duration. We may modify, suspend, or discontinue features, impose storage or bandwidth limits, or set gallery retention periods. Where a change materially reduces core functionality you have paid for, we will give reasonable advance notice where practicable.

You are responsible for keeping your own backup copies of media that is important to you.

15. Suspension & Termination

We may suspend or terminate your account if you materially breach these Terms, create legal risk for us or other users, fail to pay amounts due, or if we are required to do so by law. Where reasonable, we will notify you and give you an opportunity to remedy the issue before termination.

You may close your account at any time. After closure or termination, your galleries and Content will be scheduled for deletion within a reasonable period, subject to legal retention obligations and media already lawfully delivered to other users. For a limited window after closure, you may request an export of your own uploaded Content where technically feasible.

16. Warranty Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements, that transmission of media over the internet is fully secure, or that Content uploaded by users is accurate or lawful.

Content in galleries is created and uploaded by users. We do not pre-screen all Content and are not responsible for user Content, though we act on valid reports as described in these Terms.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of or inability to use the Service. Our total aggregate liability for claims relating to the Service will not exceed the greater of the amounts you paid to us in the twelve months before the claim arose or the minimum amount required by applicable law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.

18. Indemnification

You agree to indemnify and hold us, our officers, employees, and partners harmless from claims, damages, liabilities, and reasonable legal costs arising from your Content, your breach of these Terms, your violation of any law, or your infringement of any third party’s rights, including privacy and intellectual property rights of people depicted in media you upload.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles, and subject to any mandatory consumer protections of the country in which you reside.

If a dispute arises, contact us first — most issues can be resolved informally through support. Disputes that cannot be resolved informally within 30 days will be referred to arbitration or the courts of competent jurisdiction in Nigeria, except that either party may seek injunctive relief for infringement of intellectual property or misuse of the Service in any competent court.

20. Changes to These Terms

We may update these Terms as the Service, the law, or our practices evolve. When we make material changes, we will update the “Last updated” date and version above and notify registered users by email or in-app notice before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. Prior versions are available on request.
